TERMS AND CONDITIONS OF THE TIME OUT MARKET ONLINE STORE

1. Scope and Object

The present Terms and Conditions (“Terms”) are intended to regulate the provision of the Time Out Market Lisboa Online Store service (“Store”) by MC – MERCADOS DA CAPITAL, LDA., with registered office at Rua D. Luís I, n.º 19, 2.º Dto., 1200-149, Lisbon, infolisboa@timeoutmarket.com, +351 210 607 403, hereinafter referred to as “Time Out Market”. These Terms should be consulted in conjunction with the Terms of Use of the Time Out Market Lisboa website. The Store consists of providing, through the address https://store.timeout.com/en/cooking-classes/, a platform that allows the Customer, electronically, to purchase Time Out Market products and services under the terms and conditions described herein. The agreement between Time Out Market and the Customer is formed only upon acceptance of these Terms.

2. Purchase Process Information

Time Out Market will make its best efforts to ensure that the information in its Store does not contain errors. If the Customer purchases a product or service with characteristics different from those presented online, they have the right to terminate the purchase contract under applicable legal terms. Time Out Market will do everything possible to provide all ordered products, but in cases beyond its control, such as human error or computer system anomalies, it may not be possible to provide some requested products. If a product or service is unavailable after the order has been placed, the Customer will be notified via email or telephone. At that time, the possibility to cancel the order with a refund or, for cooking workshops, receive a voucher of equal value to choose another date/time will be offered. The Customer may not demand further compensation, interest, or indemnities beyond the aforementioned return in cases of stock breakage or information errors on the site. All information on prices, products/services, specifications, and promotions may be changed at any time by Time Out Market. Time Out Market reserves the right to accept only MB Way, credit card, or debit card payments and exclude any other means of payment. Payments are processed by a service provider to whom Customers provide data directly. We do not store Customer payment information.

3. Information on Services Provided by Academia Time Out

These Terms apply to workshops and vouchers available at www.store.timeout.com/vouchers-de-oferta/. The Customer may purchase workshop tickets or gift vouchers.

Workshop Tickets:

  • After the online purchase, the Customer receives the workshop ticket at the email address provided.
  • To participate, the electronic ticket must be presented and validated by a staff member.
  • Time Out Market reserves the right to request proof of purchase or refuse entry if the ticket is not considered valid.
  • If you have any food intolerance, restriction, or allergy, please contact us before making the purchase at academia@timeout.com. The Academy will assess the possibility of adaptation and respond via email. Time Out Market is not responsible for omissions or inaccuracies in this data.
  • Workshops start promptly; entry is prohibited once the workshop has begun.
  • There are no assigned seats; disposition is indicated by a staff member. Participants are organized in groups of 2 or 3 unless otherwise indicated.
  • Each ticket is valid for one person aged 18 or over. For Masterkids workshops, one ticket is valid for one child (ages 6-14) and one accompanying adult.
  • Participants under 18 must be accompanied by a responsible adult; both must present a valid ticket. Identification may be requested to prove age.
  • The primary language is Portuguese.
  • No exchanges, returns, or refunds are made for tickets.
  • To cancel, you must notify academia@timeout.com at least 10 days in advance. A 6-month gift voucher will be issued. If purchased with a voucher, it will be reactivated with its original expiration date.

Gift Vouchers:

  • Vouchers are for single-use, valid for 1 year, and cannot be extended.
  • Upon purchase, you will receive a PDF voucher via email which can be personalized.
  • Vouchers are valid only for cooking workshops (one or more tickets for any workshop or masterclass) and exclude other products.
  • The expiration date is the deadline to exchange the voucher for a ticket, regardless of the workshop date.
  • No returns or refunds are made for vouchers.
  • Places are subject to availability.

To redeem a voucher, the Customer must:

  • Access https://store.timeout.com/en/cooking-classes/.
  • Choose a workshop and date with availability.
  • Choose the number of tickets.
  • Apply the code on the site and wait for the discount.
  • Click finalize.
  • If the value is higher, pay the difference; if lower, the difference is not refunded.
  • You will receive an order confirmation followed by an email with the ticket.
  • Prices include operation costs and VAT.

4. Customer Obligations

The Customer agrees to provide correct and current personal data and not use false identities. Orders must be placed by those 18 or older (or with legal representative authorization). Information transmitted by the Customer has full legal effect, and the lack of a signature cannot be claimed for non-compliance. Time Out Market is not responsible for delays or impossibilities caused by incorrect or insufficient data. In case of breach, Time Out Market may block Store access or cancel future services.

5. Protection of Personal Data

Mandatory data in the order form is essential for Store operations. Customers are responsible for data accuracy. Customers have the right to access and update data via privacy@timeout.com. Reading the Privacy Policy is mandatory for purchase.

6. Cancellations, Returns, and Refunds

  • At Customer’s Request: No exchanges or refunds are made. Cancellations made 10+ days in advance result in a 6-month voucher; less than 10 days are not accepted. If paid by voucher, it is reactivated with the original date. This exchange is allowed only once per Customer.
  • Lack of Conformity: For goods (not workshops), Customers have a 3-year right to repair, replacement, or price reduction under DL 84/2021.
  • Right of Withdrawal: There is no right of withdrawal for workshops under DL 24/2014. It does not apply to physical store purchases.
  • By Decision of Time Out Market: Time Out Market may refuse orders for data errors or misconduct. Refusals or refunds may occur due to technical errors in values or lack of technical means. If a workshop is cancelled, rescheduling or a refund (within 14 days) will be offered. If paid by voucher, a new 1-year voucher will be issued instead of cash.

7. Communications

Notifications may be made via email, SMS, or telephone. Customers may opt-in to newsletters and can unsubscribe at any time.

8. Dispute Resolution

Customers may use arbitration mechanisms or the Electronic Complaints Book at www.livroreclamacoes.pt.

9. Applicable Law

Relationships are governed by these Terms and Portuguese Law. Omissions follow distance selling customs and the AMD Code of Ethics.
